Men Cell Delhi: आपका Advocate ही सामने वाले का भी lawyer निकले तो? Conflict of Interest समझिए
लेकिन अगर वही lawyer किसी ऐसे व्यक्ति के लिए भी appear कर रहा हो जिसके interests आपसे टकरा रहे हैं?
यहीं Focus करना जरूरी है।
16 March 2026 को Delhi High Court के एक matter में Court ने एक counsel को specifically caution किया क्योंकि वह दो ऐसे लोगों की ओर से appear कर रहे थे जो एक ही site पर competing claims कर रहे थे। Court को यह भी बताया गया कि वही counsel पहले उनमें से एक व्यक्ति के लिए appear कर चुके थे। Court ने कहा कि भविष्य में ऐसा conflict of interest नहीं होना चाहिए।
यह सिर्फ property dispute की कहानी नहीं है।
यही सवाल matrimonial dispute में भी उठ सकता है। Property matter में भी। Family settlement में भी। Business dispute में भी। कभी-कभी husband को लगता है कि advocate के पास उसके सारे confidential facts हैं—लेकिन क्या उसने यह भी पूछा है कि क्या lawyer किसी opposite-interest person के लिए भी काम कर रहा है?
अब Emotion समझिए।
आपने अपने advocate को marriage की पूरी कहानी बताई। Wife की complaint बताई। Financial position बताई। Property documents दिए। Police proceedings की जानकारी दी। शायद ऐसी बातें भी बताईं जो आपने अपने family members से छिपाई हों।
क्यों?
क्योंकि आपको लगा—“ये information मेरे case को बचाने के लिए है।”
अब imagine कीजिए कि बाद में आपको पता चलता है कि उसी professional relationship में कोई conflict है।
तुरंत मन में एक डर आता है—“मेरी confidential information का क्या?”
यहीं Agitation आता है।
हर situation automatically misconduct नहीं होती। हर common advocate appearance भी conflict नहीं होती। लेकिन जब clients के interests genuinely clash करते हों, या advocate की previous representation relevant हो, तब conflict को casually ignore करना समझदारी नहीं है। Delhi High Court का March 2026 order इसी practical danger को सामने लाता है।
इसलिए Men Cell Delhi या Mencell Delhi खोजने वाले husband को सिर्फ lawyer की designation, office size या बड़े-बड़े promises नहीं देखने चाहिए।
एक simple सवाल पूछना चाहिए:
“क्या आपने पहले opposite side या उससे जुड़े किसी व्यक्ति को represent किया है?”
और अगर answer complicated हो, तो documents लेकर independent review लेना शर्म की बात नहीं है।
Purush Aayog Delhi search करने वाले husbands के लिए यह और भी important है, क्योंकि matrimonial disputes में एक छोटी-सी information भी कभी-कभी settlement, police complaint, property claim या reputation issue से जुड़ सकती है।
Repetition:
अपनी information को समझिए।
अपनी documents की copies रखिए।
अपनी legal strategy जानिए।
Potential conflict पूछिए।
और अगर कुछ uncomfortable लगे, तो देर से जागने के बजाय जल्दी second opinion लीजिए।
यही difference है blind dependence और informed legal support में।
Atur Chatur Counselling का approach किसी client को यह कहकर डराना नहीं है कि “आपका lawyer गलत है।” पहले facts देखिए। कौन किसके लिए appear कर रहा है, previous representation क्या थी, interests actually clash करते हैं या नहीं—फिर conclusion निकालिए।
क्योंकि एक अच्छा support system आपको सिर्फ Court में लड़ने के लिए नहीं तैयार करता। वह आपको यह समझने में भी मदद करता है कि आपकी तरफ से कौन लड़ रहा है, किस capacity में लड़ रहा है और कहीं कोई avoidable conflict तो नहीं है।
आपकी career, finances, reputation और relationship पहले ही pressure में हो सकते हैं। Court case में uncertainty को और बढ़ाना जरूरी नहीं।
और अगर आपको लगता है कि आपकी current representation में conflict, divided attention या कोई unexplained overlap है, तो अगली critical hearing आने का इंतजार मत कीजिए। पहले file और representation structure को समझिए।
